A bill was introduced in the Indiana Senate that will provide companies that construct and operate pipelines the authority to use eminent domain to acquire pipeline right-of-ways for carbon dioxide (CO2) pipelines. This is not a new concept. Indiana has existing legislative statutes that provide eminent domain rights for pipelines that transport other products. The bill will amend the existing statute to include pipelines that transport carbon dioxide.

The DOE announced the names of the projects selected to receive funding for carbon capture and sequestration projects. The funding is from the American Recovery and Reinvestment Act. ConocoPhillips received approximately $3,000,000 for its project to capture and sequester CO2. Leucadia Energy received funding for two projects: the Lake Charles Cogeneration project received approximately $540,000 and the Mississippi Gasification received approximately $840,000.

The NETL, a DOE agency, has issued a report that estimates the volume of CO2 that could be stored long term under Federal land. DOE has released a report that estimates the amount of CO2 that can be sequestered under Federal land titled “Storage of Captured Carbon Dioxide Beneath Federal Lands“. The report estimates and characterizes the storage potential that lies beneath some of the more than 400 million acres of Federal land available for lease.
